To perform a Writ search, you can search by names already entered in your Realti file or by manually entering a Name or Execution Number.
When searching, syntax matters. Be sure to insert a comma after you type the last name of the individual. This will tell the system that you are searching for an individual and not a corporation. Since the registry is separated into Individuals and Corporations, it is important to enter the name correctly to search the correct database. Failing to enter the name correctly may not provide accurate results.
Search By Name
Select the Name(s), or add another name if it is not currenlty in your file and click on Search. The results screen lists the name of each person in the left-hand navigation. Click on a name to view their details. Clicking on an Execution # will order and display the Writ Details Report in PDF format for that particular execution.
Search by Execution Number
When you search by execution number, the returned results include the Writ Details Report plus the Certificate No. and Issued and Effective Dates.
Similar Name Executions
This is used to clarify the identity of a debtor who shares a similar name to that of the lawyer's client, who has incorrectly been designated as the debtor. For example, this can happen when the client and debtor only differ regarding their middle name, which may not be readily apparent.
The Similar Name Executions Wizard can be used to assist in clarifying whom the execution is against, the Actual Name (client), the Name on Execution, if it is a Similar Name and the details of the execution. The details of the execution can be entered on this screen. Using the wizard will help manage the different name results that may appear from the Writ Search. After entering the information for each execution, an Edit button will appear and allow you to enter further information about the execution and how it should be handled.
For example, if the execution is indeed against your client, entering the details on the Issues WorkBench item will allow you to generate letters for payout, reporting to your client, and adding the payout to your trust statement.
If the execution is a Similar Name, you can use the Similar Name Execution Wizard to draft an execution affidavit clarifying the simliar name.
The Executions - Affidavit document for clients to sign can be generated. If the execution is for over $50,000 then the lawyer will need to generate and sign the Executions - Statutory Declaration (Solicitor's).
